If your breath test yielded a result of over .08% -- or if you refused to take a blood test -- your license will be confiscated and you will automatically be served with a notice of suspension and a 30 day temporary driver’s license. Your first offense will result in a four month suspension. A refusal to submit to a test, or a second offense within ten years of your first offense, will earn you a one year suspension. With the help of an experienced DWI / DUI attorney, your suspension can be contested. Whether or not you hire a DUI attorney, you must contact the DMV within ten days of being arrested. If not, the suspension will automatically take place and there will be no recourse.
