California DUI Penalties Are Based Upon Your Number Of Past DUI Offenses
Understand How A California DUI Penalty Is Assessed
If you are facing a DUI arrest in California, there are a number of California DUI penalties you might face. The California DUI penalty you receive is based largely on the number of times you have been found guilty of a DUI.
If you are 21 years or older, you can expect the following California DUI penalties:
- First Offense – Your license will be suspended for four months if you submitted to a chemical test and exceeded a blood alcohol level of .08. If you refused the test, your California DUI penalty requires your license to be suspended for one year. If you submitted to the test, you may be eligible for a restricted license after one month.
- Second Offense – If your second offense occurs within seven years of your prior offense and you submitted to a chemical test, your California DUI penalty will be a one year suspension. If you refused a test, your license will be revoked for two years.
- Third Offense – If the third offense occurs within seven years of the prior offense and you submitted to a chemical test, your license will be suspended for two years. If you refused the test, it will be revoked for three years.
- Fourth Offense – By this stage, your California DUI penalty is the same whether you submitted to a test or not: a four year revocation of your license.
In addition to license revocation, additional California DUI penalties may be levied by the court, including fines and house arrest.
