Know The Tests That Can Lead To A BUI Arrest If "You Fail"
Understand Field Sobriety Tests And California BUI Laws
If you get stopped for a possible California BUI, there are a number of field sobriety tests that the officer may implement to help determine if a BUI arrest should be made. Some of these include:
- Nystagamus
- Walk And Turn
- Standing On One Leg
- Finger To Nose
Each of these field sobriety tests is meant to help the officer determine if you are guilty of drinking and boating.
The Nystagmus, for example, involves asking you to watch an object as it is moved from side to side. By watching for involuntary jerking of your eyes, the officer is supposed to be able to determine if a BUI arrest should be made.
The Walk And Turn test involves asking you to take nine heel-to-toe steps and then turn and take nine steps back. The officer watches your balance and your ability to follow directions. If you have difficulty with the test, you may be arrested for a California BUI.
When asking you to “Stand On One Leg”, the officer is looking to see if you can keep your balance. The officer is also listening to what you might say during the test that may be suspicious --- either of which may lead to a BUI arrest.
The Finger To Nose test involves closing your eyes and touching your nose. Again, the officer looks to determine if a BUI arrest should be made based upon body tremors and your ability to stand still.
The reality of these sobriety tests is that even combined together, they often produce inaccurate results. If you fail just one part of one of them, that's enough to get you arrested. The last time I checked, when you are given tests with a total of ten parts and you fail one part, that's 90% --- and that’s worth an A grade!
For this reason, you should plan to fight these results. To do it, however, you'll need an experienced DUI attorney who knows how to get the results of these tests thrown out of court.
