Will I go to jail?
On a first offense, probably not. On second or later offenses, it becomes more probable, but an experienced attorney may be able to keep you out.
If my DUI is reduced to a Wet Reckless, what do I gain?
Not much. In California both are counted as prior alcohol driving offense crimes for seven (7) years. Both a Wet Reckless and a DUI may be considered by other states as prior alcohol driving offenses, DUIs certainly will be considered priors across state lines.
But, Wet Reckless may avoid an ignition interlock device for multiple offenders and a suspension for all. A conviction for Wet Reckless will still require you to attend a class, at your expense.
I had two alcohol offenses when I was younger. What will happen to my license if I have a third conviction?
If your priors are within seven years of the current offense, your license will likely be revoked for two years and you will likely be sentenced to at least 120 days in jail. Work furlough may be available in some counties.
I have four serious offenses within seven years, what will become of my license?
It will be automatically revoked for 3 years. More importantly, this number of offenses can and is charged as a felony in many counties. You could be sentenced to prison. The minimum county time is 6 months.
How many hours of alcohol classes will I have to take?
For a first offense DUI, the class is a usually one night a week for 4 months. The law says 3 months, but most licensed programs require four months. If your BAC was .20% or higher, you will be ordered to take a 6 month class. The higher your BAC, the more hours you will have to take!
What will happen if I do not complete the classes or public service ordered by the Court?
You will go to jail.
I lost my California license. May I obtain a license in another state.
No. Your privilege to drive was probably suspended after your conviction. Even with an out-of-state license, your privilege to drive in California is suspended.
If I obtain an international driver's license, may I drive in California, even though my California license is revoked?
No.
Am I a bad person, because I was arrested for DUI?
No, but you are well advised never, never smell like alcohol while behind the wheel.

What if I burped within fifteen minutes of blowing?
The breath machine may have read alcohol from your stomach rather than you lungs. The result may be incorrect. A similar problem occurs with dentures.
